1. Definitions and scope
“FishyMails” is the real-time email, phone and IP verification API and related website tools operated by Second Legacy, a business registered in the Netherlands (Chamber of Commerce 87263467, VAT NL003693078B03).
“You” means the person or legal entity using the service, including any account owner, team member or end user authorised by you.
2. Service description
FishyMails provides programmatic and web-based verification of email addresses, phone numbers and IP addresses. Results are generated from public data sources, DNS records, IP reputation data and our own algorithms. We aim for high accuracy and low latency, but verification results are provided “as is” and should not be the sole basis for legal or high-risk decisions.
3. Account and API keys
To access paid features and the API, you must create an account. You are responsible for keeping your API keys, passwords and account credentials secure. You must notify us immediately if you suspect unauthorised use of your account or API keys.
Free accounts receive a monthly credit allocation. Unused free credits do not roll over unless explicitly stated in the product. We may change free-tier limits or features at any time with reasonable notice.
4. Subscriptions, billing and refunds
Paid plans are billed monthly or annually through Stripe, depending on the plan you select. Prices are shown excluding VAT; applicable taxes are calculated at checkout.
- Monthly plans renew automatically every month until cancelled.
- Annual plans renew every 12 months unless cancelled before the renewal date.
- You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period.
- Refunds are generally not provided for partial months or unused credits, unless required by law or at our discretion.
5. Acceptable use
You may use FishyMails only for lawful purposes and in compliance with these terms. You may not:
- Use the service to verify data you are not authorised to process, or to bypass consent or other legal requirements.
- Resell, scrape, systematically copy or build a competing product from the API or website content without our written permission.
- Submit content that is illegal, infringing, harassing, discriminatory, malicious or harmful.
- Interfere with the service infrastructure, exceed reasonable rate limits, or attempt to gain unauthorised access.
- Use the service to support spam, phishing, fraud, abuse or other harmful activities.
We may suspend or terminate access, without refund, if we reasonably believe you are violating these rules.
6. Intellectual property
FishyMails and its branding, code, content and documentation are owned by Second Legacy or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the service during your subscription. You may not reverse-engineer, decompile or redistribute the service or its outputs except as permitted by law.
7. Data processing and privacy
Your use of the service is also governed by our Privacy Policy. You are responsible for ensuring that you have a lawful basis to submit any personal data for verification, and for complying with your own obligations under applicable privacy laws.
8. Limitation of liability
To the maximum extent permitted by law, Second Legacy is not liable for indirect, incidental, consequential, special or punitive damages arising from your use of or inability to use the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
We do not guarantee that the service will be uninterrupted, error-free or suitable for every use case. You are responsible for evaluating whether the verification results meet your needs.
9. Indemnification
You agree to indemnify and hold Second Legacy harmless from claims, damages or expenses arising from your misuse of the service, your violation of these terms, or your infringement of any third-party rights.
10. Termination
Either party may terminate the agreement at any time. On termination, your API keys may be deactivated and your access to paid features may be suspended. Sections that by their nature should survive termination (liability, indemnity, intellectual property) will survive.
11. Governing law and disputes
These Terms of Use are governed by the laws of the Netherlands. Any dispute will be submitted to the competent court in the Netherlands, unless mandatory local law requires otherwise.
12. Changes to these terms
We may update these Terms of Use from time to time. The latest version will always be available at this URL. Material changes will be notified by email or through the dashboard. Continued use of the service after changes means you accept the updated terms.
